With Ottawa introducing a new hardscaping contractor licence, there’s been a lot of confusion about what it means for homeowners.

Fences, Decks, and Pools Do NOT Require a Hardscaping Licence
If you’re building or hiring work for:
- Fences
- Decks
- Pools
…these do not require a hardscaping contractor licence.
They are governed by separate by-laws and building requirements, such as fence regulations and pool enclosure rules—not the new hardscaping licence system. (more info)
What the Licence Actually Covers
The new licence—required as of March 2026—applies specifically to contractors doing hardscaping work in Ottawa. (more info)
This typically includes:
- Driveways and private approaches
- Interlock and patios
- Walkways and pathways
- Retaining walls and similar surface work (City of Ottawa)
In short, it targets ground-level construction that affects grading, drainage, and city infrastructure.
Why the City Introduced It
Ottawa brought in the licence to address ongoing issues with:
- Poorly executed driveway and interlock work
- Drainage problems affecting neighbouring properties
- Damage to City right-of-way areas

Where the Confusion Comes From
Because this falls under a broader “landscaping” review, many homeowners assume it applies to all outdoor construction.
It doesn’t.
The City clearly separates:

This new licence is targeted—not universal.
